Supervision and Inspection Results
Activity carried out by DGEG within the scope of Supervision and Inspection of the SCE
Within the scope of its competences in the Energy Certification System for Buildings, DGEG carries out inspection actions at real estate agencies in mainland Portugal to verify compliance with the obligation to publish the energy class of properties for sale or lease by advertising entities and real estate brokerage companies, which resulted in 526 inspection actions carried out in 2022.
Within the scope of competences, the DGEG also supervises compliance with the obligation by the owner to deliver the pre-certificate or energy certificate at the time of signing contracts for the purchase and sale or lease of real estate, having carried out, in 2022, 95 inspection actions.
Report on activity carried out by ADENE within the scope of the SCE
In line with the current legislative framework, the combination of article 27 of Decree-Law no. 101-D/2020, of December 7, in its current wording, and Order no. 6476-B/2021, of July 1, in its current wording, it follows that ADENE is responsible for verifying the quality of the information produced within the scope of the ETS, detecting any situations of non-compliance in the processes carried out by the ETS technicians, based on the selection criteria and established methodologies .

In point 3.2. of Order No. 6476-B/2021, of July 1, in its current wording, determines the analysis methodologies applicable to the processes of verifying the quality of the information produced within the scope of the Energy Certification System for Buildings (SCE) . In this context, monitoring of the PQ is foreseen in carrying out visits to the building.

Under the terms of number 5 of article 12 of Decree-Law no. 101-D/2020, of December 7, in its current wording, GES must maintain a minimum level of energy performance under penalty of being subject to preparation, submission on the SCE Portal and implementation of a Building Energy Performance Improvement Plan (PDEE), under the terms defined in Dispatch 6476-D/2021, of 1 July. The PDEE and the respective Implementation and Monitoring Reports (RIA) are subject to quality verification, defining in point 2.3 of the above-mentioned order that the analyzed sample must correspond to at least 10% of the documents issued.
